Affiliate Status
In order to be compensated for affiliate referrals, you must register as an affilitate and provide
the mailing address where compensation will be sent.
You will also have to provide all necessary income tax form required.
To register as an affiliate, simply check the "Affiliate" checkbox and the "I Have Read the Affiliate Terms & Conditions"
checkbox, at the bottom of the user registration form. If you have allready registered, you may go to the "Site Map" and click on
"Change User Information" and check the appropriate affiliate checkboxes at the bottom of the form.
Affiliate registration is limited to US Residents
Term & Conditions
By registering as an affiliate in the eBuys USA Affiliate Program (the "Program"),
You agree to the Affiliate Program Terms and Conditions set forth below.
eBuuys USA may amend these Terms and Conditions from time to time by notification to You via US Postal Service
at the address specified when you registered as an affiliate.
Amendments will become fully enforceable on the date specified in your notification letter. You will be given a minimum
of two (2) weeks to review the Revised Terms and Conditions.
If You do not agree to the Revised Terms and Conditions, You agree to terminate your affiliation with the Program through your account,
and to cease promoting eBuys USA by removing any banners or textlinks to eBuys USA.
Any payouts due you under the Pre-Amended Terms & Conditions will continue as agreed.
SPAM
You agree that you will not, under any circumstances send commercial electronic mail messages as defined in the new
Federal spam law, the CAN-SPAM Act of 2003, with respect to this Affiliate Program.
eBuys USA reserves the right to withhold, or cancel any and all compensation related to email spamming activity
and to terminate the affiliate.
eBuys USA Name
You Will Not purchase or register search engine keywords, or search engine terms that include the word "eBuys USA" or
any variations thereof for use in any search engine, through natural or paid search or any other referral service.
Specifically, this policy prohibits You from bidding on or using:
eBuys USA's trademark, "eBuys USA", and any keyword structure that includes this term.
Example, "eBuys USA Auctions", "eBuys USA Classifieds", "eBuys Auctions", etc.; and
Variations of eBuys's trademark:
Example "eBuys", "ebuys_usa", "e-buys", "e-buysusa", "e buys USA", "www.ebuys", "www.ebuysusa.com"
In the event thayt we determines, that you have purchased,use "eBuys USA" or any of the variations as shown above,
eBuys USA may at its sole discretion pursue any remedie to resolve the conflict of interest, which may include but is not limited
to: Terminate the affiliate, cancel any and all compensation.
Web Sites & Email links
You Will Not utilize a Web site or email Link(s) that contain or promote, any of the following content:
Illegal, Obscene, Violent, Libelous, Hate-oriented, Defamatory, Abusive, Bigoted, Cracking, Hacking Warez,
or any Illegal Goods and/or Service.
Additionally, you Will Not place Links to eBuys USA's site or eBuy USA Listings in newsgroups, message boards,
unsolicited email or other types of spam, banner networks, link farms, counters, chatrooms, guestbooks, IRC channels
or through similar internet marketing resources.
Bad Faith
You Will Not cause any transactions to be made "In Bad Faith" through any device, program, robot, Iframes, hidden frames, redirects
or by clicking on Links that You place to eBuys USA.
Special Offers
You Will Not Offer any kind of incentives or special promotions or use any kind of deceptive marketing efforts to entice new users to
register with eBuys USA. Any Special promotions or incentives on your part, other than "then current " offerings by eBuys USA on it's site,
must be submitted to eBuys USA affiliate management team for approval and cannot be used without written permission from eBuys USA.
Domain Names and URL's.
You Will Not use "eBuysusa" or any confusingly similar variation of "eBusyusa in your domain name(s) or
URL, including subdomain name(s) or URL path(s).
Your eBuys USA Listings.
You Will Not place any affiliate links of any kind, anywhere on eBuys USA's site, to include but not limited to:
Any Auction, Classified, Specialty Services, Want Ads listings or on eBuys USA Stores to include the store's home page
and any of its store item listings or on any of eBuys USA's link pages, Anouncement Pages, Forums etc...
Compensation Schedule.
The Compensation Schedule detailed below is effective starting in October, 2004. Compensation will be paid to registered users
who have also registered as affiliates and submitted any income tax forms reguired by eBuys USA.
Compensation is paid on or around the first of the second month after the current month. Example. All payouts for registrations in the month
of January, will be paid on the first of March, or on the first of any month thereafter when the payout would be $50.00 or more.
Active Registrations:
eBuys USA will pay between $5.00 and $15.00 for each active registration referred to eBuys USA
Payout amount is based on the number of active registrations in a given month, see table below
An active registration is when:
A New User referred by your link, registers at eBuys USA and within 60 days of registration,
Places a bid on an Auction Item or Purchases an Auction Item using the "Buy It Now" feature
or Purchases any Fixed Price Auctions, Classified, Specialty Services or Lists 1 to 9 Items For Sale
Bids & Purchases:
In addition to Registration compensation, affiliates can earn between $0.10 and $0.15 for 1 Bid per auction or $0.25 for each purchase
made through the "Buy It Now" feature or purchases of Fixed Price Auctions, Classified Ads or Specialty Services
by your referral with 30 days of registration
Residuals:
eBuys USA will pay affiliate 10% of all seller fees collected for referred sellers that lists 50 to 99 different items
(auctions, Fixed Price Auctions, Classified ads) within 30 days of registrtion. (Items must be tangible items)
Residuals commission payouts will be on going as long as referred seller is trading with eBuys USA.
Bonuses:
eBuys USA will pay bonuses as listed below for sellers that list 10 or more items within 30 days of registration.
The bonus is per registration, (regardless of the number of monthy referrals) and in addition to any other compensation
Note: The seller bonus promotion may be changed from time to time or terminated by eBuys USA at any time.
Unqualified Bids & Purchases
A Bid or Purchase will be considered unqualified if the sale is not consumated in any way. Meaning that if the buyer does not
pay for and take delivery of the item purchased or if the Seller does not accept payment for and deliver the item sold
or it is determined that the bid or purchase was placed in a fraudulant manner to create an active registration.
Transactions where a Referred User bids on the Referring User's Items, will be considered unqualified during
the "No Fees" Promotional Period
No compensation will be given for unqualified Bids & Purchases and if allready paid, the payout will be charged back against
future compensation

Breach of Terms & Conditions
If you breach any of these Terms and Conditions, You may be Suspended or Terminates from the Program immediately
depending on the gravity fo the Breach. If Suspended you will be given from 3 days to 2 Weeks (depending on the cause
of the suspension) to remedy the cause. In the event that you do not remedy the cause of the suspension, we reserve the right
to terminate your affiliate status immediately and any compensation from the date of the suspension forward.
